Welcome to Learning Lab (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Learning Lab online learning platform (the “Platform”), accessible via our website and other digital channels. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use Learning Lab.

5. Fees and Payments

Some courses or features may require payment. Prices are in New Zealand dollars (NZD) and include GST where applicable.
Payments are processed securely via payment processor.
Refunds are available in accordance with our Refund Policy (link to be provided).

6. Course Access and Licensing

When you purchase a course or resource, you are granted a limited, non-transferable licence to access and use the content for personal or business use only.
You may not redistribute, resell, or publicly share the content without our written permission.

7. Intellectual Property

All content on Learning Lab — including videos, documents, branding, and code — is protected by copyright and intellectual property laws.
All rights not expressly granted in these Terms are reserved by Learning Lab or our content partners.

8. User Content

If you post or submit content to the Platform (e.g., comments, feedback, assignments), you grant us a non-exclusive, royalty-free, worldwide licence to use and display it in connection with the Platform.
You warrant that you have the right to share this content and that it does not infringe any third-party rights.

9. Third-Party Services

Learning Lab may contain links or integrations with third-party services (e.g., video hosting, payment gateways). We are not responsible for the content, privacy policies, or terms of use of those third parties.

10. Service Availability

We aim to provide uninterrupted access to the Platform but do not guarantee availability. We may suspend the Platform for maintenance, upgrades, or security purposes.

11. Limitation of Liability (as permitted under NZ law)

To the fullest extent permitted by New Zealand law:
We are not liable for any indirect, incidental, or consequential loss, including loss of business, income, or data, arising from your use of the Platform.
Our total liability is limited to the amount you paid for the affected service, if any, in the 3 months prior to the claim.

12. Consumer Guarantees

Nothing in these Terms is intended to exclude your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986, where applicable.

13. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms or misuse the service. You may also delete your account at any time.

14. Privacy

Your personal information is collected and managed in accordance with our Privacy Policy and the Privacy Act 2020 (NZ).

15. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted on our website. We recommend checking this page regularly. Continued use of the Platform indicates acceptance of any changes.
